Simon Robin Limited ("Organiser") is a Hong Kong based business. It is the Organiser of icanmake.art's current competition ("Competition"). All entrants should carefully read and fully understand and accept the following terms and conditions (“Terms and Conditions”) prior to enrolling in the Competition.

Description of the current Competition
The Competition is a global online artwork contest open to all.
The current Competition theme is: “PACIFICATION, find peace with your [he]art.” (“Theme”).
The current Theme serves as a call to action for people to use their creative expressions as a force for positive change.

Eligibility/Entry Requirements
2.1. Participants must be at least 18 years old. However, minors may take part in this Competition, provided that their parents pay the entry fee, fill in and sign the Competition entry form(s).
2.2 Each entrant can submit as many artworks as he/she wants. Incomplete, inaccurate or late entries will not be accepted.
2.3.The entry fee is fixed at 8 euros per artwork submission/application, payable online via credit card.
2.4. Each artwork application must be submitted before 31 January 2024 GMT. Late entries will not be accepted.
2.5 Entrants are free to create anything regarding the current Theme, yet the Organizer has the right to disqualify any artwork which is obscene, vulgar, sexually explicit, lewd, derogatory or offensive. Artworks must comply with safety and have to respond to the local laws.
2.6 Artwork type: the Organiser will accept all kinds of visual art forms, including but not limited to drawings, paintings, photographs, sculptures, land art, and digital art. Please note, for this Competition, entries involving videos or music will not be considered.
2.7 Entrants will have to give a title and a brief description (maximum 300 characters) for their artwork providing insight into their creative process or inspiration.
2.8 The artwork will be submitted in JPEG, PNG or JPG format under a 5MB file (“File”). No other format or size other than the aforementioned File will be accepted.
2.9 Only original artworks created by the participant will be accepted. The design concept statement and the artwork must be the entrant’s original and sole work without infringing any intellectual property rights and/or other rights of any person or entity. Therefore, in case of plagiarism or reproductions of existing artwork(s) or in the event where the artwork entry violates any laws (including but not limited to infringement of intellectual property), the Organizer has the sole and absolute discretion to disqualify or disallow such entry and its decision shall be final and conclusive.
2.10 Each entrant should submit an artwork with a valid and accurate email address. A confirmation email will be automatically sent to the provided email address upon the entrant’s successful submission of the entry. Entrants are advised to check the junk or spam folder in case the confirmation email does not appear in the primary inbox. Entrants are also advised to follow Icanmake.art, Facebook and Instagram for updates on the Competition.

Selection process, Awards and Prizes
3.1 The artworks will be evaluated and selected by a panel (“Panel”). This Panel will be made of qualified individuals possessing expertise in the art industry. They will collectively select the artworks according to the criteria outlined below. An individual third-party will be engaged to validate the Panel’s deliberation process in order to ensure impartiality and fairness of such deliberation.
3.2 Entries will be selected as follows: the Panel members will first conduct initial screenings to evaluate their creativity, originality, relevance to the Competition Theme, their emotional impact, and the artistic techniques used by the entrants for each artwork. Based on these criterias, the Panel will choose the best twenty (20) artworks. Subsequently, the Panel will perform a more detailed evaluation of the top twenty (20) entries and rank them accordingly.
3.3 Decisions reached by the Panel shall be final and non-appealable. However, the Organizer reserves the right to forfeit the award(s) from the winner(s) and transfer them to such other entrant(s) as the Organiser deems fit if the winner(s) is / are disqualified for any reason whatsoever at the discretion of the Organizer, including breach of and / or non-compliance with the Terms and Conditions.
3.4 The Organizer has absolute discretion as to the total number of awards and prizes to be awarded in this Competition. The prizes will be subject to any changes thereto as the Organiser sees appropriate.
3.5 Winners of the awards will be notified separately via email within 1 week starting from the day after the result announcement. Failure of any winner to respond to the notice within 1 week starting from the day after the notification receipt will lead to forfeiture of the award, which may then be awarded to another appropriate entrant. Winners are advised to check the junk or spam folder in case the confirmation email does not appear in the primary inbox.

Property Rights / Intellectual Property Right
It is expressly understood that the entrants retain the full ownership of the intellectual rights pertaining to their original artwork itself. However, all entrants agree that by participating in this Competition, the Organizer has the right to display, without any payment of fees or royalties to them, the pictures of the original artwork content, title, synopsis and the entrants’ information in any form of media for demonstration, publication, exhibition, promotion or any other non-commercial activities.
The Organiser also has the right to edit, translate, adapt, use, copy and distribute, in whole or in part, the pictures of the artworks without the prior consent of – and without any payments of fees/royalties to the entrants.

Personal data
5.1 For the purposes of this Competition, the entrant will have to provide the Organiser with personal data. Failure to do so shall result in his/her non-acceptance to this Competition 5.2 Each entrant warrants and represents to the Organizer that all personal data provided for the purposes of this Competition are true and accurate.
5.3 Each entrant confirms that he / she consents to the use by the Organizer of the personal data for the purposes of this Competition, such use to be in accordance with the Personal Data (Privacy) Ordinance.
5.4 The personal data collected for the purposes of this Competition will be kept by the Organizer till the end of the Competition, and will be kept until he / she ceases to be a member of the Competition and thereafter destroyed within a reasonable time. The entrant or member may request access or make changes to the personal data already submitted to the Organiser by calling at (+33) 6 63 66 79 29 or sending email to admin@icanmake.art.
5.5 The Organizer may disclose the personal data collected to third parties for the purpose of this Competition and to the external service providers or website developers or other parties engaged by the Organizer to assist with the development, organisation and administration of the Competition. Such disclosure shall be limited to this Competition only, at the exception of any other competitions.

Disclaimers
6.1 No claims, actions or legal proceedings in connection with the Competition or participation in the Competition brought by any participant will be entertained by the Organizer.
6.2 The Organizer reserves the right to change the details of the Competition and to cancel the Competition at any time without prior notice. In case of cancellation of the Competition, the submission fee will be paid back to the participant.
6.3 By participating in this Competition, all participants agree to release, discharge, exempt, indemnify, and hold harmless the Organizer, its partners, affiliates, subsidiaries, advertising agencies, agents, and their respective employees, officers, directors, and representatives from any and all claims, losses, and damages arising out of or in connection with their participation in this Competition or any Competition-related activities. This includes, but is not limited to, any claims brought by a third party against the Organiser related to the infringement of the intellectual property rights of such third party’s works of art by the participants, as well as the acceptance, use, misuse, or possession of any prize awarded in this Competition.
6.4 The Organizer assumes no liability for any error, omission, interruption, deletion, or missing data, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorised access to the Competition entry forms; or alteration of entry forms. The Organiser is not liable for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the Internet or on any website, human errors of any kind, or any combination thereof, including any damage to the entrants’ or any other persons’ computers related to or resulting from the submission , uploading, or downloading of any materials for this Competition.
6.5 The Organizer shall not be liable to the participants for any failure or delay in the performance of its obligations due to the occurrence of a force majeure event i.e. any event beyond its reasonable control such as, but not limited to governmental decision, outbreak and spreading of any epidemics or pandemics, disturbance or failure of the internet, electricity shortage, war (declared or not), death of any member of the Panel…

Miscellaneous
7.1 The power to interpret the Terms and Conditions shall be vested in the Organizer.
7.2 The organiser reserves the right to modify or amend these Terms and Conditions at any time.
7.3 This Competition and the Terms and Conditions shall be governed by the laws of Hong Kong SAR.
7.4 All disputes in connection with or arising out of the competition shall be submitted to the courts of Hong Kong.
7.5 The English version shall prevail over the French version in the event of any inconsistency or conflict between these two versions. The French version is for reference only.
